The Secretary-General of the ASEAN Secretariat, acting on behalf of the ASEAN Secretariat,

and

The Secretary-General of the ASEAN Inter-Parliamentary Organization (herein after referred to as AIPO) acting on behalf of the AIPO Secretariat.

Having regard to Article 2 (3) of the Agreement on the Use and Maintenance of the Premises of the ASEAN Secretariat, 25 November 1981, which stipulates, inter alia, that the ASEAN Secretariat may make space available within the premises to ASEAN organizations, governmental as well as non-governmental, only on conditions acceptable to the Government of the Republic of Indonesia and the ASEAN Secretariat;

Desiring to implement the decision of the Fifth Meeting of the Twenty Fourth ASEAN Standing Committee, Kuala Lumpur, 7-9 May 1991 which agreed to AIPO's request to locate its Secretariat at the ASEAN Secretariat Building in Jakarta temporarily until such time that it can move into its own building;

Fully conscious of the temporary nature of the use of the part of the premises of the ASEAN Secretariat by the AIPO Secretariat;

Have agreed as follows :

1. The AIPO Secretariat is allowed by the ASEAN Secretariat to temporarily use the Sixth Floor of the ASEAN Secretariat Building. Such use, regardless of its duration, shall not prejudice the exclusive use by the ASEAN Secretariat of the premises located at 70A, Jalan Sisingamangaraja, Kebayoran Baru as stipulated in the Agreement on the Use and Maintenance of the Premises of the ASEAN Secretariat, 25 November 1981.
   
   

2. The AIPO Secretariat shall be responsible for the cost of maintenance and upkeep of ',,he Sixth Floor of the ASEAN Secretariat.
   
   

3. The AIPO Secretariat shall be responsible for its use of public services.
   
   

4. The AIPO Secretariat shall contribute to the cost of the services and facilities commonly used by both the AIPO Secretariat and the ASEAN Secretariat. The apportionment of the said cost shall be calculated by the ASEAN Secretariat and mutually agreed upon.
   
   

5. The AIPO Secretariat shall vacate the premises of the ASEAN Secretariat upon securing its own premises.
   
   

6. The ASEAN Secretariat is entitled at any time to terminate the grant of temporary use of the part of its premises by the AIPO Secretariat by notifying the AIPO Secretariat at least 180 days in advance.
